By visiting the Site, placing an order, or using any products purchased from KhloMar, you agree to be bound by these Terms.

Availability: Products are subject to availability and may be modified or discontinued at any time.
Clothing & Apparel Disclosure
Clothing and apparel items are intended for standard consumer wear.
Fit, sizing, drape, and appearance may vary based on body type, garment cut, fabric composition, and manufacturer specifications. Customers are responsible for reviewing size charts and product descriptions prior to purchase.
Color variations may occur due to lighting, screen display differences, or production batches and do not constitute defects.
Normal variations in fit, fabric feel, personal preference, or styling expectations do not qualify as product defects.
KhloMar is not responsible for damage resulting from improper washing, drying, storage, or care of garments. Care instructions should be followed as provided.
Return eligibility for clothing is governed exclusively by the Refund Policy, including original condition requirements.

No Medical Advice: KhloMar does not provide medical guidance, diagnosis, or treatment.

By purchasing and using fitness-related products, you acknowledge and agree that:

7. Beauty, Skincare, & Personal Care Tool Disclaimer
Beauty, skincare, & personal care tools may cause irritation, redness, burns, allergic reactions, or sensitivity depending on individual skin type and use.
You acknowledge that
- Results vary by individual and are not guaranteed
- A patch test should be performed when applicable
- Use should be discontinued if irritation occurs
- Instructions and warnings must be followed
To the fullest extent permitted by law, KhloMar is not responsible for adverse reactions resulting from product use or misuse.
8. Results Not Guaranteed
Individual results vary based on personal factors including age, body type, fitness level, skin type, frequency of use, and adherence to instructions. KhloMar does not guarantee outcomes, performance improvements, or specific results.
Any examples, testimonials, or images are for illustrative purposes only and represent individual experiences.
9. Assumption of Risk
You knowingly and voluntarily assume all risks associated with product use, including personal injury, allergic reactions, and property damage, to the fullest extent permitted by law.
10. Product Instructions & Proper Use
Customers are responsible for:
- Reading and following all instructions, warnings, and safety guidelines
- Using products only as intended
- Exercising reasonable care and judgment
Improper use, misuse, or modification may void eligibility for refunds or replacements as allowed under our Refund Policy and applicable law.
Refunds are generally available for items that arrive damaged, defective, or incorrectly shipped, in accordance with our Refund Policy. In limited circumstances, non-damaged items may also be eligible for return and refund, as outlined in this policy.
11. Orders, Pricing, & Payments
Pricing: All prices are listed in U.S. dollars and may change without notice.
Order Review: We reserve the right, at our sole discretion, to refuse, cancel, or limit orders due to suspected fraud, pricing errors, inventory issues, or abusive purchasing patterns.
If an order is canceled after payment, an appropriate refund will be issued to the original payment method, subject to processor timelines.
12. Shipping & Third-Party Fulfillment (Dropshipping Disclosure)
KhloMar may use third-party suppliers and fulfillment partners, including dropshipping providers, to source and ship products.
Delivery Estimates: Shipping times are estimates only and not guaranteed.
Risk of Loss: Risk of loss transfers once the order is handed to the shipping carrier, and in certain circumstances, to the customer, to the fullest extent permitted by law.
Address Accuracy: Customers are responsible for providing accurate shipping information. We are not liable for loss or misdelivery due to incorrect addresses.
13. Tracking Information
Tracking details will be sent via email when available. Please allow up to 48 hours for updates. Orders with multiple items may ship separately.
If tracking does not update within 7 business days, contact khlomar.store@outlook.com before filing a dispute.
If tracking shows an order as delivered, additional documentation may be required to review refund or replacement requests, as outlined in our Refund Policy.
14. Errors, Inaccuracies, & Omissions
We reserve the right to correct errors or inaccuracies in pricing, descriptions, or availability and to cancel affected orders, even after submission.
15. Sales Tax
KhloMar is based in Mississippi.
Mississippi Orders: Applicable Mississippi sales tax (typically 7%) is collected on orders shipped to Mississippi addresses.
Other States: We do not currently collect sales tax in other jurisdictions. You may be responsible for paying use tax to your state.
16. User-Generated Content
By submitting reviews, testimonials, images, or tagging KhloMar on social media, you grant KhloMar a non-exclusive, royalty-free, worldwide, perpetual license to use such content for marketing and business purposes.
We reserve the right to remove content that is unlawful, misleading, abusive, or infringing.
17. Electronic Communications
By communicating with KhloMar electronically, you consent to receive communications electronically and agree that such communications satisfy any legal requirement that they be in writing.
18. Returns, Refunds & Chargebacks
Returns, refunds, replacements, and store credit are governed exclusively by the Refund Policy.
You agree to contact KhloMar before initiating a chargeback.
KhloMar reserves the right to provide delivery confirmation, policy acceptance records, and fraud documentation to contest disputes.
Fraudulent disputes may result in refusal of future service.
19. No Warranties
To the fullest extent permitted by law, all products and services are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you.
20. Limitation of Liability
To the maximum extent permitted by law, KhloMar shall not be liable for indirect, incidental, special, consequential, or punitive damages.
KhloMar’s total liability for any claim shall not exceed the amount paid for the product giving rise to the claim.

You agree to indemnify, defend, and hold harmless KhloMar and its owners, officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising from your use or misuse of products, violation of these Terms, or violation of any law or third-party rights.
22. Intellectual Property
All content on the Site—including text, images, graphics, logos, and design elements—is owned by or licensed to KhloMar and protected by applicable laws. Unauthorized use is prohibited.
23. Third-Party Links
The Site may contain links to third-party websites. KhloMar does not control or endorse third-party content and is not responsible for their policies or practices. Access such sites at your own risk.
24. Force Majeure
KhloMar shall not be liable for delays or failures caused by events beyond our reasonable control, including natural disasters, pandemics, supplier interruptions, carrier delays, labor disputes, governmental actions, or outages.
25. Termination
We reserve the right to terminate access to the Site or refuse service at any time for conduct that violates these Terms or is harmful to our business.

27. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Mississippi, without regard to conflict-of-law principles.
Any disputes shall be resolved exclusively in the state or federal courts located in Mississippi, and you consent to personal jurisdiction in such courts.
28. Assignment
KhloMar may assign or transfer these Terms, in whole or in part, without restriction. You may not assign these Terms without prior written consent.
29. Severability, Survival & Headings
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
Sections relating to limitation of liability, indemnification, warranties, intellectual property, and governing law shall survive termination of these Terms.
Headings are for convenience only and do not affect interpretation.
30. Entire Agreement
These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and KhloMar regarding use of the Site and purchase/use of products.
